The Sentencing: Three Years Plus Treatment Program
Criminal Division 11 of the Seoul Western District Court sentenced Mr. A on the 23rd of last month on charges of quasi-rape. Beyond prison, he was ordered to complete 80 hours of a sexual violence treatment program and was banned for five years from working in institutions related to children, adolescents and persons with disabilities.
The Case: What the Court Found
The case dates back to March 2024, when Mr. A was brought to trial on charges of sexually assaulting a woman he had known for a long time in a motel in Seodaemun District after drinking together.
Mr. A admitted to the sexual relations but claimed the victim was not incapacitated and that the encounter was consensual. The court, however, pointed out that Mr. A contradicted or subtly changed his statements after being presented with objective evidence. In contrast, the court found the victim’s testimony consistent, reasonable and supported by objective evidence, deeming it credible.
In its sentencing, the court stated: “The defendant persistently encouraged the victim to drink despite her reluctance, and exploited her intoxicated and incapacitated state to commit the crime, reflecting the seriousness of the offense. Denying the crime and shifting blame onto the victim also exacerbated her mental suffering.”
